Terms of Service

Welcome to You Were There ("we", "our" or "us"). These Terms of Service ("Terms") govern your use of the You Were There mobile application (the "App") and of the website youwerethere.app. By creating an account or using the App, you agree to these Terms.

1. Acceptance of Terms

By creating an account or using the App, you confirm that you are at least 13 years old (or 16 in the European Union), that you agree to these Terms and that you have read our Privacy Policy. If you do not agree to these Terms, you must not use the App.

2. The service

The App creates AI-generated images of you from a photo you provide, using ready-made scenes or a description you write yourself. Results depend on the photo and on the AI and may vary from one attempt to the next. The App needs an internet connection. We may add, change or remove scenes and features over time.

3. Account Registration

• You must provide accurate and complete information when creating your account.
• You are responsible for keeping your account credentials confidential and for all activity under your account.
• You must notify us immediately of any unauthorized use of your account.
• You can delete your account at any time from Profile → Delete account.
• We may suspend or terminate accounts that violate these Terms.

4. Credits & Payments

• The App uses a credit-based system: each AI image generation consumes credits, as shown in the App.
• Free credits may be provided on registration, periodically to active users, and as invitation rewards, under the conditions shown in the App at the time.
• Additional credits can be bought as one-off in-app purchases through the Apple App Store or Google Play. There are no subscriptions.
• Credits have no cash value, cannot be transferred or exchanged for money, and are lost when you delete your account.
• Purchases are processed by Apple or Google, and refunds are handled by them under their own refund policies. This does not affect any rights you have as a consumer under mandatory law.
• We may change credit prices, free credit amounts and the credit system in the future; changes do not affect credits you have already bought.

5. Your photos and other people

• Only upload photos of yourself, or of people who have agreed to it. If a photo shows a minor, you must be their parent or legal guardian.
• Only upload photos you have the right to use.

6. Acceptable Use

You agree not to use the App to:

• Create deepfakes or content intended to make others believe that a fabricated scene is real
• Remove or alter the AI labels, watermarks or metadata of generated images in order to pass them off as real photos
• Generate content that is illegal, harmful, threatening, abusive, defamatory or obscene
• Impersonate real people, celebrities or public figures in misleading ways
• Create nudity, sexual content or pornographic material
• Generate content promoting hate, violence, discrimination or terrorism
• Infringe the intellectual property rights or privacy of others
• Use the App for any commercial purpose without our prior written consent
• Attempt to reverse-engineer, hack or exploit the App or its systems

Violations may result in immediate suspension or termination of your account.

7. Content Ownership

• You keep all rights to the original photos you upload.
• By uploading photos, you grant us a limited, non-exclusive licence to process them solely to provide the service, including sending them to our AI provider as described in the Privacy Policy.
• AI-generated images created through the App are yours to use for personal, non-commercial purposes.
• If you publish an image in the public Showcase, you grant us a licence to display it, together with its title, description and the description used to create it, within the App until it is removed.

8. AI-Generated Content

• Images are created by artificial intelligence and may contain errors, imperfections or unrealistic details.
• We do not guarantee specific results, quality levels or accuracy of generated content.
• Generated images are creative and entertainment content, not factual representations, and are marked as AI-generated.
• You are solely responsible for how you use and share them. Do not present them as real photographs.

9. Moderation & Suspension

• Descriptions written by users are checked automatically against our content rules before an image is generated.
• We may review, moderate and remove any content that violates these Terms.
• We may issue warnings, temporary suspensions or permanent bans for violations. A strike system applies: repeated violations lead to escalating consequences.
• We may act on the basis of automated detection or manual review. You can contact us at [email protected] if you believe a decision was wrong.

10. User-Generated Content & Community Safety

The public Showcase lets users publish AI-generated images. We operate a zero-tolerance policy for objectionable content and abusive behaviour. By using the App you agree that:

• You will not post objectionable content — including harassing, hateful, sexual, violent or otherwise abusive material — and you will not abuse other users.
• Every published image can be flagged by any user directly in the App, from the photo detail screen.
• Every user can block the author of a published image. Blocking immediately removes that author's content from your feed and notifies our moderation team.
• We review reported content and remove violating content and eject the offending user within 24 hours of a report.
• Repeated or severe violations lead to permanent account termination.
• You can review and undo your blocks at any time from Profile → Blocked users.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "as is" and "as available" without warranties of any kind.
• We are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the App.
• Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.
• We are not responsible for any loss of data, photos or credits due to technical issues beyond our reasonable control.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for wilful misconduct or gross negligence, or your statutory rights as a consumer.

12. Governing Law

These Terms are governed by the laws of Italy. If you are a consumer, you also keep the protection of the mandatory provisions of the law of the country where you live, and you can bring proceedings before the courts of the place where you live.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by email before they take effect. If you do not agree with the changes, you can stop using the App and delete your account; if you keep using it after the changes take effect, the updated Terms apply.
